A discussion was held about short term rentals beginning with public comment:
- Should have rules and regulations; enforcement will be an issue
- Concerned with the amount of people staying in rentals (parking, noise and sewer concerns)
- Most houses zoned R1 for one family dwellings; for residential one family dwellings
Attorney Harry Golski spoke regarding this difficult issue. This problem is growing and widespread. There are two different ways to control this problem. 1) Zoning ordinance, which regulate land use 2) through ordinance passed under the police power regulations, which has nothing to do with a specific property, but with nuisances, parking, noise, etc. On May 21st, 2019, the Michigan Court of Appeals announced a decision, which is the first and only published decision in the Michigan Courts regarding this issue. The decision states that if you are renting out your property for profit, then it becomes a business and is not allowable in a R1 district. The case has been appealed to the Michigan Supreme Court. It was recommended that the matter be referred to the Planning Commission for public hearing and investigation/research.
