Call to Order

The Charlevoix Township Board meeting was called to order by Supervisor Center with Board Members Christiansen, Rajewski, Witherspoon and Williams.

Plaque was presented to Robert Rajewski in honor of his service to Charlevoix Township as the Zoning Administrator from 1985 to 2019 in sincere thanks for his service.

The minutes of the year end budget meeting held on June 27, 2019 and the regular July 8, 2019 Board meeting were accepted.

Financial Report

The financial report was given by Treasurer Williams. As of the end of July, the General Fund was at $594,850.40; Water Fund $65,458.54; the Fire Department $107,655.59; Trust and Agency $1,385.56; Fire Department Bond Retirement fund $143,351.96; and the Fire Station Construction Account $1,421,460.67. of the updated budget was given to the board for review and discussion. Rajewski made the Motion, with Witherspoon supporting, to approve the updated budget. Motion carried unanimously. (M-36-19)


Water Department: Working on replacing the few remaining meters.

Fire Department: None

Zoning Department: Update from John Ferguson. Working on a few complaints.

New Business

The contract for North by Nature to maintain the gardens on the south side of town was reviewed and discussed. The proposed contract is for $2,500. Witherspoon made the Motion, with Christianson supporting, to approve the contract. Motion carried unanimously. (M-37-19)

A discussion was held about short term rentals beginning with public comment:

  • Should have rules and regulations; enforcement will be an issue
  • Concerned with the amount of people staying in rentals (parking, noise and sewer concerns)
  • Most houses zoned R1 for one family dwellings; for residential one family dwellings

Attorney Harry Golski spoke regarding this difficult issue. This problem is growing and widespread. There are two different ways to control this problem. 1) Zoning ordinance, which regulate land use 2) through ordinance passed under the police power regulations, which has nothing to do with a specific property, but with nuisances, parking, noise, etc. On May 21st, 2019, the Michigan Court of Appeals announced a decision, which is the first and only published decision in the Michigan Courts regarding this issue. The decision states that if you are renting out your property for profit, then it becomes a business and is not allowable in a R1 district. The case has been appealed to the Michigan Supreme Court. It was recommended that the matter be referred to the Planning Commission for public hearing and investigation/research.

Martin Road resurfacing (from Waller to Ance) was discussed. Christianson made the Motion, with Williams supporting, to approve the resurfacing. Motion carried unanimously. (M-38-19)

North Fire Barn parking lot resurfacing was tabled to the next meeting as the bid was not in yet.

Casey Riley has been on staff since last summer. Christianson made the motion, with Rajewski supporting, to increase his pay to $15 per hour. Motion carried unanimously. (M-39-19)

Steve and Kathy Paterka wrote regarding reducing the speed limit on Waller Road. A study has been ordered.

Township Insurance renewal was reviewed and discussed. Christian made the motion, with Williams supporting, to approve the insurance renewal for the upcoming year. Motion carried unanimously. (M-40-19)

Laura Stebe wrote a letter requesting support for the skate park. Rajewski made the Motion with Christianson supporting, to give the skate park $500. Motion carried unanimously. (M-41-19)

A thank you was received from the Northern Lakes Economic Alliance.

A letter was received from Mr. Hillman requesting that Mushroom House Tours by Edith Pair be stopped. The tours go by his house every half hour, with people viewing into his home and speaking loudly during the tours.

Christianson made the Motion, with Rajewski supporting, to allow the Clerk to pay bills presented. Motion carried unanimously. (M-42-19)

Public Comments: The public walkway from Michigan Avenue to Lake Michigan is dangerous. Site Planning will be asked to take a look at the walkway.
